Terms of Service

These Terms of Service ("Terms") govern your use of the Chrome extension "Instant Tab Recorder" and associated websites (collectively, the "Service") provided by the Instant Tab Recorder developer ("Provider"). By installing or using the Service, you agree to be bound by these Terms.

1. Applicability and Relation to the MIT License

  1. These Terms apply to all interactions between users ("Users") and the Provider regarding the use of the Service.
  2. The source code of the Service is licensed under the MIT License ("OSS License"). Regarding the copyright rights to copy, modify, merge, or distribute the source code, the OSS License shall take precedence. For the use of the Service (extension binaries and websites), these Terms shall apply.

2. Features of the Service and Data Handling

  1. Free of Charge: The Service is provided free of charge.
  2. Local Processing: All recording, audio, and transcription data generated by the transcription feature are processed and stored locally on your device. The Provider does not transmit, collect, or store your recording data, audio data, or transcription data on any remote servers.
  3. Privacy: Handling of user data is conducted in accordance with our Privacy Policy.
  4. External Services: The Service uses Sentry for crash report management and performance improvement. Users can opt out of event reporting at any time via the extension options page.
  5. Model Data Download: Using the transcription feature requires downloading necessary model files directly to the user's device from external services. Any data communication charges incurred thereby shall be borne by the user.

3. Prohibited Activities

Users shall not engage in any of the following acts when using the Service:

  1. Acts that violate laws, regulations, or public order.
  2. Acts related to criminal activities.
  3. Infringement of copyrights, trademarks, privacy rights, portrait rights, or any other rights of third parties.
  4. Interfering with or disrupting the functionality of servers, networks, or systems of the Provider or third parties.
  5. Acts that interfere with or are likely to interfere with the operation of the Service.
  6. Any other activities deemed inappropriate by the Provider.

4. Disclaimer of Warranties and Limitation of Liability

  1. AS IS Basis: THE SERVICE AND ANY OUTPUTS GENERATED BY THE TRANSCRIPTION FEATURE (INCLUDING BUT NOT LIMITED TO ACCURACY, COMPLETENESS, USEFULNESS, AND FITNESS FOR A PARTICULAR PURPOSE) ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
  2. Limitation of Liability: IN NO EVENT SHALL THE PROVIDER BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SERVICE OR THE USE OR OTHER DEALINGS IN THE SERVICE (INCLUDING LOSS OR CORRUPTION OF DATA, RELIANCE ON TRANSCRIPTION RESULTS, DATA CHARGES OR NETWORK ISSUES ARISING FROM DOWNLOADING MODEL FILES, DEVICE MALFUNCTION, OR BUSINESS INTERRUPTION); PROVIDED, HOWEVER, THAT THIS SHALL NOT APPLY IN CASES OF INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE BY THE PROVIDER.
  3. User Responsibility: Users use the Service at their own risk and assume full responsibility for all content recorded and saved, as well as transcription data generated using the Service.

5. Modifications, Suspension, and Termination

The Provider reserves the right to modify, suspend, or terminate the Service at any time without prior notice. The Provider assumes no liability for any loss or damage incurred by users as a result of such changes or termination, except in cases of intentional misconduct or gross negligence by the Provider.

6. Revisions to Terms

The Provider may revise these Terms as necessary due to changes in laws, regulations, or the Service. In the event of revisions to these Terms, the Provider will notify users of the contents and the effective date of the revised Terms by posting on the website, within the Service, or through other appropriate methods. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

7. Governing Law and Jurisdiction

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. Any disputes arising out of or in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court in Japan.
  3. The Japanese language version of these Terms shall be the original and governing version. In the event of any conflict or discrepancy between the Japanese version and any translation, the Japanese version shall prevail.
